‘House of Illustration’ Flickr Group

This Flickr group (‘Group’) has been created in conjunction with the House of Illustration’s exhibition ‘What Are You Like?’ (‘Exhibition’) on show at Dulwich Picture Gallery from 9 September 2008 – 18 January 2009. The Group is run by the House of Illustration, 16 Lincoln’s Inn Fields, London WC2 3ED (‘we’, ‘us’ and ‘our’). ‘You’ and ‘your’ shall mean you, the person participating in the Group.

Before you share your artwork with the ‘House of Illustration’ Flickr Group, please read these Terms carefully. They contain standards which you must comply with, and important information about the rights that the House of Illustration (HOI) will have to use your work.

Terms and conditions for contributors

1. General
   1. Access to the Group is provided by Flickr, and by sharing your artwork with the Group, you agree to Flickr’s Terms and conditions, provided at http://www.flickr.com/guidelines.gne, and the Yahoo! Terms of Service at http://uk.docs.yahoo.com/info/terms.html. In the event of any conflict between such Terms of Use and these Terms and Conditions, then the latter shall prevail only with regard to our use of your content for the purposes set out in 2 below.
   2. By sharing your artwork with the ‘House of Illustration’ Flickr Group you also agree to the House of Illustration’s Terms and conditions, set out here.
   3. Flickr Terms and Conditions take precedence over the Competition Terms and Conditions.
   4. The House of Illustration retains the right not to show images posted on the site. We also retain the right to take it, and any text accompanying it, down if we deem to be obscene, libellous, defamatory, inappropriate, inciting racial hatred, terrorism or to be offensive in any way. If you do not follow these Terms and conditions we may remove your artwork or text from the site and bar your access to the Group.
   5. The HOI reserves the right to cancel the ‘House of Illustration’ Flickr Group and Competition at any time.
   6. The competition is open to UK and overseas residents.
   7. This agreement is governed by the laws of England and Wales.
   8. Only entries submitted to the ‘House of Illustration’ Flickr Group will be accepted.
   9. The HOI does not accept any responsibility for late or lost entries due to any problems with uploading to Flickr.
   10. The HOI’s decision is final in every situation including any not covered above and no correspondence will be entered into.
2. Rights and permissions
   1. By sharing your artwork with the ‘House of Illustration’ Flickr Group, in respect of each artwork you grant to the HOI a non-exclusive, worldwide, royalty-free, licence to display the photograph of your artwork (downloaded from Flickr in high-resolution) on the HOI's website (http://www.houseofillustration.org.uk) and/or from HOI's server (including in a live gallery), in printed form as part of an exhibition display, and/or in online and offline materials connected with the What Are You Like Competition and/or Exhibition, such as the HOI newsletter, educational or publicity material. Your Flickr Username will appear with your artwork.
   2. This licence shall apply for the period during which the artwork is posted in the ‘House of Illustration’ Flickr Group. If you remove your photo from the ‘House of Illustration’ Flickr Group, this licence will automatically terminate.
   3. The Group shall remain available as a static site on Flickr after the Exhibition has closed.
   4. To be clear, unless the HOI has contacted you and obtained your approval, it will only use your artwork by displaying it on the HOI’s website and/or from the HOI’s server (including in a live gallery), or in materials such as on a gallery display panel or in the HOI’s newsletter or educational or publicity material promoting the project, where such display is directly connected with the HOI What Are You Like? Exhibition. Your artwork may be archived in perpetuity on the HOI website.
   5. We will not use your photograph for any commercial purposes whatsoever, or for any purposes other than those set out in 2 above.
3. Your obligations
   1. By sharing your artwork with the ‘House of Illustration’ Flickr Group, you confirm that:
      • it was made by you;
      • it is your own original work;
      • sharing it with the ‘House of Illustration’ Flickr Group and granting a licence in respect of its use as set out in these Terms will not infringe the copyright or any other rights of any third party;
      • it does not contain any obscene or defamatory content or material.
4. Our obligations
   1. The HOI shall not be obliged to display your artwork and shall not have any liability to you for any loss of publicity or enhancement of reputation.
   2. Your personal information will only be used and, where necessary, disclosed to third parties for the purposes of running the competition, and otherwise in accordance with the HOI online Privacy Statement.
   3. We will not pass on your personal details to any other organisation without your permission, except for the purposes of running the competition.
   4. If you do not want to grant the House of Illustration the rights set out above, please do not share your artwork with the ‘House of Illustration’ Group on Flickr.
